The ('Sweepstakes') begins on September 4th, 2022, and ends on October 1st, 2022, at 10am (the 'Promotion Period').
The sponsor of this Sweepstakes is Foundation 45 Preowned Supercenter ('Sponsor'). By participating in the Sweepstakes, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of the Sponsor, which shall be final and binding in all respects. The sponsor is responsible for collecting, submitting, or processing Entries and the overall administration of the Sweepstakes. Entrants should look solely to the Sponsor with any questions, comments, or problems related to the Sweepstakes. ELIGIBILITY: Open to legal residents of The United States of America, living in Texas, who are aged 18 or over (the 'Entrant'). Sponsor, and their respective parents, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies, and each of their respective officers, directors, and employees and employee's family (the 'Promotion Entities'), are NOT eligible to enter the Sweepstakes or to win a prize. In the event the aforementioned person is the winner, The Sponsor will review eligibility and will make a final decision if to honor such entry or invalidate it. This Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited or restricted by law. LIMITED TO ONE SWEEPSTAKES WIN PER PERSON / ONE HOUSEHOLD PER YEAR, AND MAY EXCLUDE ADDITIONAL IMMEDIATE FAMILY MEMBERS EVEN IF NOT IN THE SAME HOUSEHOLD. Subject to review.
HOW TO ENTER: Enter the Sweepstakes during the Promotion Period online by visiting the entry form, which can be found on the following website at https://www.foundation45mitsubishi.com/win.htm . Automated or robotic Entries submitted by individuals or organizations will be disqualified. Internet entry must be made by the Entrant. Any attempt by Entrant to obtain more than the stated number of Entries by using multiple/different email addresses, identities, registrations, logins or any other methods, including, but not limited to, commercial contest/sweepstakes subscription notification and/or entering services, will void Entrant's Entries and that Entrant may be disqualified. Entry by mail, e-mail, and any means other than on Foundation 45 Mitsubishi’s online electronic sweepstakes on the designated website URL entry form is prohibited. Final eligibility for the award of any prize is subject to eligibility verification as set forth below. All Entries must be posted by the end of the Promotion Period to participate. The sponsor's database clock will be the official timekeeper for this Sweepstakes.

WINNER SELECTION: The Winner(s) of the Sweepstakes will be selected in a random drawing from among all eligible Entries received throughout the Promotion Period. The random drawing will be conducted LIVE on SOCIAL MEDIA via Facebook, Instagram, and TikTok by the Sponsor or its designated representatives (AutoWon.com). If selected, winner will have 60 seconds to respond. Otherwise, winner will forfeit and runner up selected. The process continues until a winner is found. Decisions are final. The odds of winning will vary depending on the number of eligible entries received.
WINNER NOTIFICATION: The winner will be notified via LIVE Social Media Transmission (Facebook, Instagram, and TikTok). Potential Winner must accept by replying to the live transmission as directed by Sponsor within 60 seconds of name announcement. Sponsor is not responsible for any delay or failure to receive notification for any reason, including inactive email account(s), technical difficulties associated therewith, or Winner’s failure to adequately monitor Sponsor's social media.
Any winner notification not responded to withing 60 seconds will result in prize forfeiture. If winner does not respond by response deadline, an alternate winner will be selected at random.
The potential prize winner may be required to sign and return an affidavit of eligibility and release of liability, and a Publicity Release (collectively 'the Prize Claim Documents'). No substitution or transfer of a prize is permitted except by the Sponsor.
The sweepstakes winner will be invited to participate in after-sweepstakes marketing efforts solely for public awareness. If approved, either winner's name, last name, photo, or video may be featured on websites, social media channels, in print advertising, and catalogs owned and operated by Sponsors. Announcements of the winner will be used by sponsors for promotional purposes, including but not limited to Facebook, Twitter, Pinterest, LinkedIn, YouTube, and our websites. The winner shall not receive any compensation for this and participation is not required to enter or win. Participation in the after-sweepstakes marketing efforts is completely voluntary.
PRIVACY: We value your privacy and data. It will not be shared with any third party. Any personal information supplied by you will be subject to the Sponsor's privacy policy posted on the Sponsor's website. It will be used solely to process selecting a winner and contacting you if you are selected. Through the contact/verification process, you may receive an invitation to join Foundation 45 Mitsubishi's electronic e-mail newsletter. It is NOT obligatory to join nor required to enter or win. If you opt to join our newsletter, you can always opt out at any time.
SOCIAL MEDIA AND ONLINE PLATFORMS: This promotion is in no way sponsored, endorsed, or administered by Houston Texans, nor associated with Facebook, Instagram, Twitter, Google, Linked In, or any other social media platform or search engine. You understand that you are providing your information to Foundation 45 Mitsubishi and not to any of the aforementioned digital entities. This Sweepstakes abide by Facebook’s guidelines for promotions available at the time of the Promotion Period. The sponsor intends to follow these and all other social media platform requirements. Entrants are encouraged to follow these same rules and to avoid spam and unsolicited messaging.
LIMITATION of LIABILITY: By entering, You agree to release and hold harmless Foundation 45 Mitsubishi and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Sweepstakes and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries.
DISPUTES: This sweepstake IS GOVERNED BY THE LAWS OF TEXAS, USA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Sweepstakes, the participant agrees that any disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Harris County, Texas having jurisdiction. Further, in any such dispute, under no circumstances shall the participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees. Participant further waives all rights to have damages multiplied or increased.
ADDITIONAL TERMS AND CONDITIONS: These sweepstakes prizes are non-transferable. No cash will be awarded. Tax and gratuity are not included in the prize. The value of the prizes may be taxable as income. Upon receipt of the sweepstakes prize, the winner is required to comply with any applicable federal, state, and local tax laws and pay all such taxes as becomes due concerning the sweepstakes prize. The winner will agree to indemnify and hold harmless Sponsors and their employees and agents from and against any liability for such taxes. Winners agree to adhere to the laws of sweepstakes as governed by the state of Texas. Any violation of these official rules by the winner will result in the winner's disqualification as winner of the sweepstakes and all privileges as winner will be immediately terminated. Sponsors reserve the right to disqualify any individual it finds to be tampering with the entry process or the operation of the sweepstakes; to be acting in violation of the Official Rules. If for any reason the Sweepstakes is not capable of running as planned, including the loss of entries by participants, or any other causes beyond the control of Sponsors, acts of nature, technology, legal, security, fairness, integrity, or proper conduct of this sweepstakes, Sponsors reserves the right at its sole discretion to cancel, terminate, modify or suspend the sweepstakes without any liability.
